What is the S0020 purpose code?

Purpose code S0020 is used when an Indian entity sends money abroad to pay margin, premium or settlement amounts on financial derivative transactions. This covers payments such as initial or variation margins to an overseas broker, option premiums to a foreign counterparty, and final settlement amounts under derivative contracts booked outside India. It does not apply to ordinary investment in shares, bonds or mutual funds, which are reported under separate securities investment purpose codes. Under RBI FEMA guidelines, this outward payment is classified under the capital account and reported accordingly.

When to use S0020 purpose code?

Use S0020 when you are paying an overseas broker or counterparty for margin, premium or settlement amounts arising from financial derivative contracts. It is the correct RBI purpose code for derivative related cash flows under permitted overseas investment or hedging arrangements, whether you are an Indian company or a resident individual investor. S0020 covers derivative margins and settlements, not straightforward purchase of foreign securities.

When to use a different code:

  • Use the derivative hedging purpose code for payments linked to underlying trade exposures rather than standalone investment
  • Use the securities investment purpose code when the payment is for buying shares, bonds or units abroad instead of derivative margins
  • Use the matching P code when you are receiving money rather than paying

Who typically uses S0020 purpose code?

Indian companies and LLPs that enter into permitted derivative transactions with overseas brokers or financial institutions, including corporates hedging risk through offshore derivative contracts. Resident individual investors who are allowed to undertake derivative transactions abroad and need to fund margins, option premiums or settlements with foreign counterparties also use this code.

Examples of transactions covered

  • Margin payment to an overseas broker to open or maintain a permitted derivative trading account
  • Remitting option premium to a foreign counterparty for a currency or equity derivative contract
  • Paying variation margin to an international clearing member after daily mark to market on derivatives
  • Final settlement payment to close out an open derivative position with an overseas financial institution

When NOT to use S0020 purpose code

  • The payment is for buying shares, bonds or other foreign securities outright rather than derivative margins
  • The payment is for hedging derivatives linked directly to an underlying trade transaction that has its own RBI purpose code
  • The payment relates to general investment management or advisory fees instead of derivative contracts
  • You are receiving money rather than paying (use the matching P code)

Documents required

To send a payment under S0020, keep the following documents ready so your authorised dealer bank can verify the transaction and report it correctly under FEMA.

DocumentPurpose
Form A2 with PANStandard RBI form where you declare the purpose code S0020 and your PAN for outward remittances.
Form 145Income tax undertaking for outward remittances, filed under Rule 220 of the Income-tax Rules 2026.
Derivative contract or agreementThe underlying derivative contract, broker agreement or confirmation note showing the margin, premium or settlement obligation.
Supporting regulatory filingsAny applicable approvals or filings relating to the overseas derivative position, such as ODI or other capital account compliance documents as required by your bank.

How is a S0020 Purpose Code declared?

Declaring the code is pretty straightforward. Here's how the payment gets tagged and reported.

  1. Receive the derivative statement: Your overseas broker or counterparty issues a margin call, contract note or settlement statement detailing the amount payable under the derivative contract.
  2. Complete capital account compliance: Ensure any required overseas investment or derivative related filings or approvals are in place as per RBI regulations before funding the margin or settlement.
  3. File Form 145: Submit the declaration before remitting, with Form 146 from your CA where the taxable amount exceeds ₹5 lakh in the Tax Year.
  4. Complete Form A2: State the purpose of the outward remittance as S0020 and submit the supporting documents to your bank.
  5. Get your MT103: Once the payment is sent, request the SWIFT MT103 as proof and retain your Form A2 record.

Common mistakes to avoid

A few common slips can hold up your payment or cause compliance issues. Here's what to watch for.

  1. Confusing derivatives with securities: Tagging a straightforward purchase of foreign shares or bonds as S0020 instead of using the correct securities investment purpose code.
  2. Code and invoice mismatch: The code not matching what your broker statements or contract notes describe, which flags the payment.
  3. Assuming a Rule 220(3) exemption: Skipping Form 145 on a payment that is not on the specified list, which carries a ₹1,00,000 penalty per instance.
  4. Incomplete documents: Missing contract note, broker agreement or Form A2, so the bank holds the remittance until provided.
  5. Missing PAN or KYC: Incomplete verification stops the bank from releasing the payment.
  6. Using an outward code for an inward receipt: Applying a payment code to money coming in instead of the matching P code.
